Dream Act: Obama passes amnesty by a back door ICE directive

Last Friday, with no fanfare, no press coverage, and with every effort made to hide his actions from the American people, President Obama snuck through the spirit of the DREAM Act via an ICE memo.
Opposed by a majority of the American people and twice defeated in Congress, the DREAM Act grants amnesty to any illegal alien residing in the United States if s/he agrees to enlist in the U.S. military or enter college.
The Obama administration memo to John Morton, Director of I.C.E. (Immigration and Customs Enforcement) directs I.C.E. agents now to use “prosecutorial discretion” with regard to enforcing immigration laws.
Director Morton says that Obama Administration policy directs border patrol agents not to enforce immigration laws: “When ICE favorably exercises prosecutorial discretion, it essentially decides not to assert the full scope of the enforcement authority available to the agency.”
You read that right. According to the Obama administration “favorable” enforcement means NOTenforcing the law!
Even political analyst Charles Krauthammer agrees that this is no less than the spirit of the DREAM Act.
“This is outright lawlessness on the part of the administration,” argued syndicated columnist Charles Krauthammer on a discussion panel with Fox News’ anchor Chris Wallace. “Whatever the politics of this, we do have a Constitution. And under it, the Legislature, the Congress enacts the laws and the executive executes them. It doesn’t make them up.
“The DREAM Act was rejected by Congress,” Krauthammer continued. “It is now being enacted by the executive, despite the express will of the Congress. That is lawless. It may not be an explicit executive order; it’s an implicit one.’ More…
According to one of the first press reports to break this important story, the new Obama policy is cut and dry. Federal immigration officials do not have to deport illegal aliens if they are enrolled in any type of education program, if their family members have volunteered for U.S. military service, or even if they are pregnant or nursing.
Arizona and the voter ID law
Just recently Obama’s Department of Justice (DOJ) blocked Arizona from enforcing its voter ID law. Arizona is one if not the biggest portal of illegal immigration in the nation with half a million illegal aliens coming through the sate annually. Arizona’s Attorney General Tom Horne recently stated that he believed that blocking of the law facilitated massive voter fraud by illegal aliens.
“Attorney General Tom Horne accused the Obama administration Tuesday of trying to thwart Arizona’s voter-ID laws in a bid to get more illegal immigrants to the polls — presumably to cast ballots for the president and Democrats.
Horne acknowledged that a brief filed by the Department of Justice in a case to be heard next month by the 9th U.S. Circuit Court of Appeals centers around the agency’s argument that Arizona’s law requiring proof of citizenship to register is pre-empted by federal law. But Horne, a Republican, told Capitol Media Services he sees something more sinister.” More…

The united States seems to be over riding its laws. If there is and illegal person in the United States he or she is to be arrested and deported, These so called immigrants have no citizenship. When the Government calls for Illegals to vote this may be a time for the citizens to call upon the United States Armed Forces to step in and enforce the constitution arrest all illegals and question all government officials who condone protecting illegal persons and give them aid when there are so many that they constitute and invading force to see what there motives are and if they are found to be a threat to our nations security the officials should be arrested and put on trial or dismissed from there duties.

No immigrants do not just get to become legal is they are nursing. There are specific rules, like age, background No THEY DONT GET TO BE LEGAL IS THEY HAVE FELONIES OR SIGNIFICANT MISDEMEANORS. I was in the Army for 15yrs, an served in Iraq. I was med retired with 70% disability in 2009 because of being injured in the line of duty. Ok now for my bit….. my wife and I were married in March 2003 in Nebraska. She has lived in the UK for 16yrs, so when she came to see me in July 2007 preg with are 1st child she was stopped, questioned for 4hrs then deported back to England since a Immgration officer thought she might try an stay. And yes she did have a valid visa. And to this day she is still not able to enter the USA. So when I retired I moved to England.

This article is not true….I'm so disappointed in this publication, gives the Tea Party a bad name by allowing a contributing writer to make untrue statements. Please go to snopes.com or fact check. The Dream Act has not been enacted by executive order. The Tea Party Tribune needs to check the facts before publishing articles. Now I'm afraid to read this publication for fear of being mislead.

The editor of TPT asked me to respond to your many inquiries into the accuracy of our article on the DREAM act. You are factually correct. Obama did not sign an executive order enacting the DREAM act. He did however issue a directive through ICE which accomplished the same thing. Even Charles Krauthammer of the Washington Post agreed with me. I wrote an article, several weeks ago, that specifically addresses your concerns and which will serve as an answer to your concerns. The content and title of this article is not honest enough for my liking.
You make it sound like Obama just decided to enact a piece of legislation before the Congress all on his own.
You should have made it plain in the article that the memo he wrote was not the "DREAM Act" per se, but "accomplished the same thing."
I think it would have been nice too if you would have commented on the status of the bill that was introduced in the Senate in May and its chances for passing.
It is sad to me what has happened to the "Tea Party." It started out as such a good thing but now is a big mess.

I wish the info – the executive order accomplished the same thing but was not the Dream act – had been included in the article or at least as a footnote at the end. I reposted the article all over Facebook, then called all of my Congressmen. I am in Alabama, and have fairly conservative leadership that I called. They told me this wasn't true. Had I been armed with the accurate information, I would have been better able to respond and say that, no, it wasn't the dream act, but an order that effectively accomplished the same thing. It is things like this that make it easy for politicians to dodge the real issues that they need to answer for. I will now go and look for the OTHER article.

The executive order in no way accomplishes the the same thing as the Dream Act would. The dream act would provide a path to legal permenant residency. The executive order does no such thing. Lousy and misleading reporting.

You are completely wrong in equating Obama's directive (as set forth in the Morton memo) with the Dream Act. The Dream Act would provide a path to legal permenant residency for children who came to the US before their 16th birthday, graduated from high school or got a GED and served in the military or completed two years of college. The Morton issue addresses considerations that should be made in granting prosecurorial discretion with regard to persons who may be placed in removal proceedings. People who are granted prosecutorial discretion don't get residency. You are mixing apples and oranges and doing a disservice by conflating two completely different issues.

THERE ARE illegals in the military and mexican women can stay here if they are pregnant after crossing the border illegally and/or have a new baby and the USA gives her a welfare check to boot and she can continue to have babies and continue to get a welfare check. Women who are pregnant and are illegal do deported. Id know, Ive seen it happen, anchor babies? If you mean the kids go to foster homes while the mom is in mexico waiting for resolution and then gets a 10 year penalty then sure.
NO ILLEGAL IMMIGRANT GETS HELP, get that through your head. No medicaid, no doctor, no mother effing welfare no no no no. The only help they get is regarding the care for the medical expenses for the child ONCE IT IS BORN. The disclaimer in the memo at the bottom reads that nothing in it should be construed to prohibit… or to limit the legal authority of ICE! I don't know who is the hypocrit, but definitely that memo IS! And we are found here debating whether a party is trying to give someone a bad name or having already a bad name on the basis of the implications of an empty, fully-disclaimed-for-no-authority memo!

Man, it took some digging, but I finally found out what really happened. He went in through the back door. The administration adopted a policy of giving "particular care" before deporting students, military veterans and others deemed to be low risk, while concentrating on felons, gang members and threats to national security.
Because of this in-accurate and inflammatory article, I will not take the Tea Party seriously. Certainly, will not subscribe to nor read anything else from the Tea Party Tribune.

You are right it does seem like a back door for amnesty, but if you were here illegally would you want to take a risk of being caught by Immigration? After all, this executive order has the word "discretion" and it can mean ANYTHING for ICE! But what i do not understand is what is wrong with the Dream Act? Why are most Republicans against it? The government and each state spend so much money on investing on children's education that it just goes to waste once they get older. Calfornia has this law UB540 which says that an illegal student who attended high school at least 3 years can pay in-state tuition and a four year college. This means that the state pays 75% of the tuition for an illegal.

Would it not make sense if this "illegal" have some way of paying the State back all this money? instead some would have to work under the table and pay a fraction ( if any) back to the state and government. Then we all wonder why the economy is bad? this is all correlated with immigration, lets have them help this country, pay a fine, and instead of sending their money to their own country, have them invest it here. This solution is all but difficult, but politics get in the way, both by the Democrats and Republicans.

If the undocumented/Illegal is stopped for any type of infraction, and doesn't have outstanding arrest warrants or felony record, law enforcement can simply release them at their own discretion. I suppose that being an "Illegal Immigrant" is no longer illegal!

Yes! Technically this article could have had a better headline; however, the ICE directive accomplishes the exact same thing as the DREAM act. Even Sheriff Arpaio's office has complained now that the illegal immigrants they catch are being released as soon as they are in ICE custody. This is a classic case of shooting the messenger. The Main Stream Press blew this under the rug and were it not for this article you would not know anything about this. This article was written by someone who lives in Arizona where there are 500,000 illegals blowing through the state every year, where there are beheadings in Phoenix, where the city of Phoenix is dubbed the kidnap capital of the world, where immigrants are stored 30-40 in a house at a time, where the Federal government is flooding the border with thousands of gun.
You people complaining are all high and mighty about the technical inaccuracies but the fact is that Obama has enacted a back door DREAM act and Arizonans are being slaughtered, police officers are being killed by the dozens, innocent immigrants are being brutalized all because THE FACT IS THAT OBAMA HAS ENACTED THE BACK DOOR DREAM ACT. Meanwhile you people do not look at the killings by the hundreds Arizonans have to endure. Did you know that close to 40,000 people have been killed on the US Mexico borders because of the drug wars in the last four years. Arizona police officers are being assaulted and killed because criminal elements from Mexico know that Obama does not enforce immigration laws. This latest back door ICE directive known as the back door DREAM act is what is make Arizona a very unsafe place to live. Hundreds of thousands of guns have been purchased recently by Arizonans because they are scared.
So while you are all offended because of the article people are dropping like flies here because Obama won't enforce immigration law. It is so typical of the critics to look the other way as thousands of people are being killed and throwing fits for nonsensical reasons.
The next time all you critics of this article have your two week vacation come down and take it on the Arizona border and visit the devastation and fear. You won't do it will you? That would be much too real. You would rather complain on this column and pretend that is reality. You are all fooling yourselves!

I have searched and can not find an executive order number for this. I have searched and only find Blogs reporting on it. I understand the Maim Stream Media not reporting but it is not on Fox. If it happened, however he did it, why are the Mexicans being so quite about it, that would be a great victory for La Raza. If the are not here illegally and want to serve in the Military and do so Honorably, I have no problem fast tracking them to a green card because they earned it. Collage, no, the Tax Payers pay most of the cost for them attending, if they go on our dime, they were already here illegally so no fast track to green card for them. Anyone know the number of the order please post it here.

If you read the article carefully, it says that an ICE directive implemented what is basically the equivalent of the DREAM ACT without an executive order. Go to the very last line of the article and you will see that you can read the directive in full. That directive is basically the DREAM ACT.

Just before the mass movement from Mexico, I read that Mexicans were massing along the border waiting to enter the U.S They were being sheltered and fed by Communists with the condition that when they were able to vote that they would vote Democratic. I worked with a few Mexicans after that and asked them if there were a lot of Communists coming into the US. They said, yes. The question is: Why did they come here. The answer is that they were told that the US, Canada and Mexico would become one economic market without borders. This was promoted by the Club de Rome that planned to divide the world into ten economic units. Ours being the North American Union. Doing away with our Constitution.

First off, the pretense that there was no presidential directive that passed the spirit of the Dream Act is incorrect. It is all there in plain black and white. There is even a link to the actual presidential directive. Secondly, Snopes is not known to be a reliable source of information and leans very Left-Wing. Third, with regard to James 1207 who makes all of the false claims about the Tea Party, he is an obvious Liberal who knows nothing about the Tea Party. The Tea Party backs black candidates, and at least one that I know of won a seat in congress in 2010, Colonel Allen West of Florida. Ordinarily, the individuals who are posting comments to conservative news articles are very honest and well-informed. I find it odd that there is so much misinformation regarding this article among the respondents.

wow…Gil…you read WAY too much into that memo…read the last paragraph again…it's basically saying that since resources are so low for I.C.E, that they have been given prosecutorial flexibility to not throw someone out of this country unless they really need to be exorcised from the US immediately…it doesn't give amnesty (something that Ronald Reagan did way back in 1981–signing the amnesty bill for migrant workers)…it merely allows the agency to focus their efforts on getting rid of the drug dealing/gang member/dregs that flood this country…and of course, once we throw out the illegal aliens, who will be left to exploit?? I don't get what everyone's problem is illegal immigrants plant and harvest 90% of our crops they pay thousands of dollars into our economy and will never get any of it back because they aren't eligible for the programs they help pay for. On top of that we deny them the decency of being able to transport themselves legally with a drivers licence therefore filling our jails up and wasting our tax money just cause we don't allow them to drive legally ….I think Americans forget their history and where they came from …were not all of our ancestors at one point or another illegal? or did we get permission from the native Americans to invade their land, bring disease to their people, kill thousands upon thousands of them and say it was our right because we were white …that this land belonged to us even though we didn't inhabit it first …So why in the world do we object to people coming with their families (those that do no harm) to give them a better life? an education? and just because they were born into poverty and cant meet the requirements for legal immigration we condemn them ? When the Law Breaks the Law, there is no Law. That’s where we seem to be today, Obama and his military machine, side stepping congress, voiding the constitution and violating the peoples trust in any kind of lawful system. They lead by example, the example they are setting for the American people is one that says, Laws are to be Broken and rules of law no longer matter.
Under article V of the Constitution, our founding fathers established two methods for future generations to add amendments to the Constitution.
Under method 1: Two-thirds of both houses of Congress can propose an amendment, and then three-fourths of the states ratify it… or not.
Under method 2: Two-thirds (34) of the states call for a federal constitutional convention, and then three-fourths of the states ratify whatever amendments are proposed by the convention.
Notice that ratification by states does not specify state legislatures !

Congress used a shady, yet legal, method (filibuster) to block the bill, so Obama used a shady, yet legal method (ICE memo) to pass the legislation. I'm perplexed as to why Obama is the bad guy here.
